EonAutomate is a home automation solution-based company that automates home equipment. It is one of the best companies to develop & provide solutions. EonAutomate offers the following key services to its customers:
- 1) EonAutomate Server software, which we will customize as per your requirements.
- 2) EonAutomate App that can be downloaded from Play Store.
Following Terms of Service govern a user access to use the above mentioned Services. The terms are stated as follows:
Overview, Eligibility, Customer Service, and Termination
Overview:
The EonAutomate Smart App enables you to control your Lights, Fans, Air-conditioners, Water motors, Electronic door locks & all other electrical appliances of your home, virtually from anywhere in the world.
Eligibility:
Users above 18 years of age are permitted to act as Owners of EonAutomate Accounts whereas all users of age 13 and above are eligible for its services.
Customer Service:
A 24/7 Customer Support is available on the EonAutomate Support helpline. You can even email your queries to automation.support@panchshil.com, eonautomate@gmail.com.
Termination:
These Terms will remain in full force and effect so long as you continue to access or use the Services. EonAutomate has the right to terminate your services in case of any violation of the terms and conditions mentioned in this document.
Accounts
User Account:
To use the Services, you must register for a user account and provide correct information about yourself as prompted by the applicable signup form. Every user may have a separate user account with full or limited privileges as assigned by the root account.
Account Owner:
The individual who creates an account is the account owner and is liable to the EonAutomate terms of service.
Access to Services
Product Usage:
Access and Usage are subject to these Terms. EonAutomate grants you a non-transferable and non-exclusive right to access and use the Services solely for the purpose of controlling and monitoring your own Products and installing and using the Mobile Apps for your own handheld mobile device (e.g., iPhone, iPad, or Android smartphone).
Software Updates:
EonAutomate may from time to time develop patches, bug fixes, updates, upgrades, and other modifications to improve the performance of the Services and/or the Product Software. These may be automatically installed without providing any additional notice or receiving any additional consent. You consent to this automatic update. If you do not want such Updates, your remedy is to terminate your Account and stop using the Services and the Product.
Agreed Usage and Limitations Of Automate Services
Intended Use of EonAutomate Services:
The Services are intended to be accessed and used for non-time-critical information and control of EonAutomate Products. While we aim for the Services to be highly reliable and available, they are not intended to be reliable or available 100% and may be subject to sporadic interruptions and failures for a variety of reasons beyond EonAutomate's control, including Wi-Fi intermittency, service provider uptime, mobile notifications.
No Life-Safety or Critical Uses of the Services:
You acknowledge and agree that the Products and Services, whether standing alone or when interfaced with third-party products or services are not certified for emergency response. EonAutomate makes no warranty or representation that use of the Products or Services with any third-party product or service will affect or increase any level of safety.
Ownership and Intellectual Property
EonAutomate Property:
You acknowledge that all intellectual property rights in the Product, Product Software, and Services are owned by EonAutomate and your possession, access, and use of the Product, Product Software, and Services do not transfer to you or any third party any rights to use it commercially.
Customer Feedback:
EonAutomate may invite you to submit comments, suggestions, or ideas about the Products or Services so as to improve the Products and Services.
Indemnity
You agree to defend indemnify and hold EonAutomate and its licensors and suppliers harmless from any damages, liabilities, claims, or demands that are made by any third party due to your use of our Products and Services or due to your violation of these Terms or any User Submissions or Feedback you provide.
Warranty Disclaimers
The warranty for EonAutomate products are set forth in the EonAutomate warranty card that is given with the purchase of our products. EonAutomate makes no warranty that defects will be corrected or that the services will meet exactly user requirements. EonAutomate makes no guarantee that it will be compatible with user's home network, computer, or mobile device. No advice or information, whether oral or written, obtained by you from EonAutomate or through the services shall create any warranty.
Limitation of Liability
Nothing in these Terms and in particular within this "Limitation of Liability" clause shall attempt to exclude liability that cannot be excluded under applicable law.
Fees and Payment
Certain Services may be provided for a fee. You shall pay all applicable fees in connection with the Services selected by you in accordance with the Terms of Sale.
General
Changes to these Terms:
EonAutomate reserves the right to make changes to these Terms. We'll post notice of modifications to these Terms on this page. You should ensure that you have read and agree with our most recent Terms when you use the Services. Continued use of the Services following notice of such changes shall indicate your acknowledgment of such changes and agreement to be bound by the revised Terms.
Protection of Confidentiality and Intellectual Property Rights:
Notwithstanding the foregoing, EonAutomate may seek injunctive or other equitable relief to protect its confidential information and intellectual property rights or to prevent loss of data or damage to its servers in any court of competent jurisdiction.
Entire Agreement/Severability:
These Terms constitute the entire agreement between you and EonAutomate regarding the use of the Services. Any failure by EonAutomate to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.
Assignment:
These Terms, and any associated rights or obligations, may not be assigned by you without EonAutomate’s prior written consent. These Terms may be assigned by EonAutomate without restriction. These Terms are binding upon any permitted assignee.
Notifications:
EonAutomate may provide notifications to you as required by law or for marketing or other purposes via (at its option) email to the primary email associated with your Account, mobile notifications, hard copy, or posting of such notice on www.eonautomate.com.
